The Ministry of Agriculture and Rural Affairs Further Tightens the Regulation of Pesticide Administration

Recently, the Ministry of Agriculture and Rural Affairs issued the Notice on Further Regulating Pesticide Administration Work. Centering on the implementation of the new provisions in the revised pesticide administration regulations, the notice sets forth specific requirements for relevant matters including pesticide registration, production and operation, registration testing, and label marking.

Regulating pesticide registration: It clarifies that entrusted agents shall also designate registration information officers of their own entities, and specifies that the reissuance of registration certificates shall only apply to the name change of registration certificate holders and the merger or division of enterprises.

Regulating the authorization of pesticide registration data: It stipulates that the authorization of pesticide registration data shall be limited to the first registrants and registration holders of products containing new compounds.

Regulating the entrusted production of pesticides: It requires that entrusted pesticide processing must be based on signed contracts and provision of technical data, and the trademark of the trustee shall not be marked on the products.

Regulating the online sale of pesticides: It specifies that entities engaged in online pesticide sales shall complete the filing procedures with the issuing authority, and display relevant information about the operators and products.

Regulating pesticide registration testing activities: It defines the specific circumstances of violations committed by pesticide registration testing institutions, and imposes severe penalties on testing fraud.

Regulating the requirements for marking trademarks on pesticide labels: It clarifies the specific requirements for declaring trademarks used on pesticide product labels, facilitating inquiries by pesticide users and grass-roots supervision departments.
